BrightOps Commercial SDK License
Version 1.0 · 2026-09-09
These terms apply when supplied with a BrightOps SDK order or evaluation. The Licensor is the seller identified on that order or receipt, trading as BrightOps. The Customer is the person or organisation named on it. A signed agreement takes precedence over these terms. Existing orders keep the terms they accepted.
Permission to use the SDK
A paid order grants a non-exclusive license to download the covered SDK versions, use and modify them internally, and build, test, operate and distribute the Customer's own applications containing them. End users may run those applications without buying SDK seats. Contractors acting for the Customer are covered within the purchased developer seats and must protect the SDK and credentials.
The order specifies covered packages, developer seats or company-wide coverage, price, currency and subscription period. Automated coding agents, workstations, CI jobs, build servers and application instances do not consume extra seats. A seat counts a human developer using the SDK. Included runtime dependencies are covered for use with the purchased SDK without a separate purchase.
Downloads, renewal and continued use
During an active paid term the Customer may obtain the covered versions available from the store. A version acquired while paid, and its pinned runtime dependencies, remain licensed for continued use, modification, deployment, reinstall and rebuild after ordinary subscription expiry or cancellation. The store records those exact version entitlements and permits their download with the Customer's valid key. New versions require an active entitlement. Cancellation does not switch off a running application or require its users to purchase anything.
The Customer may keep private backup copies and use an access-controlled internal package cache or registry for its licensed developers and build systems. Public mirrors and sharing with other customers are not permitted. Store availability is not guaranteed continuously; retain the package archive and lockfile for offline rebuilds. License keys are distribution credentials, never runtime configuration.
Renewal and cancellation follow the accepted order and checkout terms. These terms do not introduce a new price or billing schedule. Non-payment stops acquisition of new versions; it does not revoke paid fallback rights. Refunds follow the order and applicable law.
Evaluation
An evaluation order allows internal testing for its stated trial period. It does not permit production distribution. At expiry the Customer must purchase rights or stop using and remove trial copies. Trial downloads do not create perpetual entitlements. Evaluation does not authorise automatic charges.
Restrictions and notices
The Customer may embed the SDK in its applications and hosted services. Selling, licensing or distributing the SDK itself as a standalone SDK, package, developer toolkit or substantially equivalent library service requires a separate written agreement. Do not share license keys outside the licensed organisation, remove included copyright/license notices, or claim ownership of the Licensor's code.
The SDK's source and package notices must be retained when its code is distributed. A customer-facing BrightOps badge or advertisement is optional; this agreement does not require one. Third-party and upstream code remains governed by its own included licenses. Nothing here removes rights those licenses independently grant.
Data and operations
The Customer owns its application data and chooses its storage location, access controls, encryption, backups and retention. Purchasing a license does not upload application memory to BrightOps or grant BrightOps rights to use that memory. The local SDK works without a licensing server call. Any optional external service requires the Customer's separate configuration and applicable service agreement.
The Customer must follow the release's documented supported runtimes, storage contract and migrations, and validate its own application's use. Backup retention, customer account deletion and access authorisation remain application duties.
Support and updates
The included support and compatibility commitments are those shipped with the purchased release and stated in its order. No availability SLA is implied. Security reports, license questions and support requests may be sent to sundar@brightops.io. Published versions are immutable; fixes use new versions.
Breach, security and termination
The Licensor may suspend a compromised download key to protect the Customer and provide a replacement after verifying the Customer. A replacement preserves that Customer's paid version entitlements. Suspension is not remote deletion of data.
A material breach may terminate rights after written notice and 30 days to cure, unless the breach cannot lawfully be cured. On termination for breach, stop use and remove copies subject to terminated rights. Paid fallback rights survive ordinary cancellation, but not lawful termination for uncured material breach. Third-party rights survive according to their own licenses.
Warranty and liability
TO THE EXTENT PERMITTED BY LAW, THE SDK IS PROVIDED AS IS, WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. NO SOFTWARE CAN GUARANTEE ERROR-FREE OPERATION OR ZERO DATA LOSS.
TO THE EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE UNDER THESE TERMS FOR INDIRECT OR CONSEQUENTIAL LOSS. THE LICENSOR'S AGGREGATE LIABILITY IS LIMITED TO FEES PAID FOR THE AFFECTED SDK IN THE 12 MONTHS BEFORE THE CLAIM. THIS DOES NOT EXCLUDE LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR OVERRIDE MANDATORY RIGHTS.
General
The order and these terms form the agreement. Any agreed governing law and venue are stated in the order; otherwise applicable law determines them. Mandatory consumer protections remain unaffected. An unenforceable provision does not invalidate the rest. Transfer to a successor of the Customer's whole business is allowed if that successor accepts these terms; other transfers need consent. Changes apply to future orders unless both parties agree otherwise.
